1. Parties

GigaTechCloud Services SL (the "Provider") and the user/organization (the "Customer").

2. Service description

DBA Copilot is an AI-assisted database performance analysis tool. It processes performance reports (AWR, ASH, logs) uploaded by the user and provides AI-generated recommendations.

3. Account and access

  • One account per organization.
  • The user is responsible for keeping credentials secure.
  • Must be 18+ and authorized to represent the organization.

4. Acceptable use

  • Only upload files you are authorized to share.
  • Do not upload personal data of individuals in log files (anonymize if necessary).
  • Do not attempt to reverse-engineer or abuse the service.
  • Do not use for illegal purposes.

5. AI-generated content disclaimer

  • DBA Copilot provides AI-generated recommendations for informational purposes only.
  • Recommendations are NOT a substitute for professional DBA judgment.
  • GigaTechCloud Services SL is NOT liable for any damages resulting from applying AI recommendations.
  • Always validate recommendations in a test environment before applying to production.
  • The user assumes full responsibility for any changes made to their database systems.

6. Subscription and billing

  • Plans: Free, Starter (€19/mo), Professional (€49/mo), Team (€99/mo).
  • Billing via Stripe, monthly in advance.
  • 14-day free trial for paid plans.
  • Cancellation takes effect at the end of the billing period.
  • No refunds for partial months.

7. Service availability

  • We target 99% uptime but do not guarantee it.
  • Scheduled maintenance with advance notice when possible.
  • No SLA for the Free plan.

8. Intellectual property

  • DBA Copilot software: owned by GigaTechCloud Services SL.
  • User data and uploaded files: owned by the user.
  • AI-generated analysis: the user retains rights to their analyses.

9. Confidentiality

  • We treat uploaded performance files as confidential.
  • Files are processed by the Anthropic API (see the Privacy Policy).
  • We do not share user data with third parties except the processors listed in the Privacy Policy.

10. Limitation of liability

To the maximum extent permitted by applicable law, GigaTechCloud Services SL shall not be liable for any indirect, incidental, special or consequential damages. Total liability shall not exceed the amount paid in the last 3 months.

11. Governing law

These terms are governed by Spanish law. Disputes are subject to the courts of Zaragoza, Spain. EU consumers may also use the EU ODR platform: ec.europa.eu/consumers/odr.

12. Changes to terms

We will notify users 30 days in advance of material changes. Continued use constitutes acceptance.
